ในความผิดฐาน “ปล้นทรัพย์, ร่วมกันทำร้ายร่างกายผู้อื่นจนเป็นเหตุให้ได้รับอันตรายแก่กายหรือจิตใจ, ข่มขืนใจผู้อื่นให้กระทำการใด หรือจำยอมต่อสิ่งใด โดยทำให้กลัวว่าจะเกิดอันตรายต่อชีวิต ร่างกาย เสรีภาพของผู้ถูกข่มขืนใจหรือผู้อื่น หรือโดยใช้กำลังประทุษร้ายจนผู้ถูกข่มขืนใจต้องกระทำการนั้น โดยมีอาวุธ, หน่วงเหนี่ยว กักขัง หรือกระทำด้วยประการใดให้ผู้อื่นปราศจากเสรีภาพในร่างกาย, ทำให้ผู้อื่นเกิดความกลัว หรือตกใจ โดยการขู่เข็ญ, กระทำด้วยประการใดๆ ต่อผู้อื่น อันเป็นการรังแก ข่มเหง คุกคาม ให้ได้รับความเดือดร้อน, มีอาวุธปืนไว้ในครอบครองโดยไม่ได้รับอนุญาต และพาอาวุธปืนติดตัวไปในเมือง หมู่บ้าน หรือทางสาธารณะโดยไม่ได้รับใบอนุญาตโดยไม่มีเหตุจำเป็นและเร่งด่วน”
